Legal aid is a vital part of New Zealand’s justice system. It ensures that people are not denied access to justice simply because they can’t afford a lawyer. Legal aid funding allows eligible individuals to receive legal advice and representation for a range of criminal, family, or civil matters.

Criminal Legal Aid – Who Can Get It?

​

You may be eligible for criminal legal aid if:

​

  • You are charged with a criminal offence that carries a potential prison sentence of six months or more

  • You are appealing a conviction or sentence

  • You are appearing before the Parole Board (in some circumstances)

​

In cases involving more minor charges, legal aid may still be available where there are special circumstances, such as a mental health condition, learning difficulty, or other personal barriers that make it hard to navigate the legal process alone.

 

 

How Legal Aid Works

​

Legal aid is not always free—in many cases, it is considered a loan. Whether you will need to repay some or all of your legal aid depends on:

  • Your income and assets

  • Whether you receive money or property as a result of the case

  • Your overall financial situation, including that of your partner if applicable

 

The Legal Services Commissioner assesses applications and makes decisions based on the eligibility criteria set out in the Legal Services Act 2011.

 

 

Applying for Legal Aid

If you’re unsure whether you qualify for legal aid, we can help you understand the process and assist with your application. Legal Aid Services will assess:

  • Your gross income (before tax)

  • The value of your assets, such as property, vehicles, or savings

  • The number of financial dependants you support
